Terms of Service
1. Who supplies the service
Fermi Education is operated by Woojin Song trading as Fermi Education. Contact [email protected].
For individually matched tutoring, the named independent tutor supplies the lesson directly to the student or family. Fermi acts as the tutor’s disclosed managed agent: we advertise and match tutors, arrange bookings, collect the gross lesson fee on the tutor’s behalf, deduct our agreed commission, coordinate plans and reporting, monitor service quality, and help manage complaints, replacements and refunds.
Fermi is responsible for providing its agency and coordination services with reasonable care and skill. The tutor is responsible for providing the tutoring itself with reasonable care and skill. A Fermi-owned course, workshop, resource or separately scoped admissions-management service may instead be supplied directly by Fermi; we will identify this before booking.
2. Bookings and tutor matching
An enquiry or free consultation is not a paid booking. Before a paid booking, we confirm the named tutor or supplier, service, price, session length, delivery method and payment terms. For a student under 18, a parent or guardian should accept the booking.
Independent tutors may accept or decline proposed work. If a tutor becomes unavailable, Fermi may propose a replacement, but the replacement becomes the student’s tutor only after the family accepts. If no suitable replacement or reschedule is agreed, the affected prepaid lesson will be credited or refunded.
3. Prices, GST and payment
Prices are in New Zealand dollars unless stated otherwise. Website prices are guides until confirmed in writing. Fermi normally collects the gross lesson fee as the tutor’s disclosed collection agent and deducts its commission before paying the tutor. The family does not pay an additional agency commission unless a separate fee is clearly disclosed and accepted.
The invoice or receipt will identify the tutor or service supplier and the applicable GST treatment. GST on tutoring depends on whether the supplying tutor is GST-registered. Any service supplied directly by Fermi is treated according to Fermi’s GST status. Payment is normally due within seven days unless otherwise agreed. Fermi may pause future coordination after a reasonable reminder for overdue payment.
4. Cancellations and refunds
See our Cancellation and Refund Policy. For private tutoring, at least 24 hours’ notice allows cancellation or rescheduling without a fee. With less notice or a no-show, a reasonable charge of up to the full lesson price may apply only to reflect actual or reasonably expected loss, not as an automatic penalty. Illness and emergencies are considered individually.
If the tutor cancels, Fermi will coordinate a reschedule or suitable replacement. If neither is accepted, the affected prepaid lesson will be credited or refunded. These terms apply to future bookings and do not retrospectively alter an agreed booking.
5. Family and student responsibilities
- Provide accurate, relevant information and notify us of learning needs that affect safe or suitable delivery.
- Attend on time with suitable equipment, internet access and learning materials.
- Treat tutors and staff respectfully and follow reasonable safety directions.
- For minors, maintain age-appropriate parent or guardian oversight and current emergency contact details.
- Check official school, NZQA, examination and university requirements and submit applications accurately and on time.
6. Safeguarding and conduct
Our Student Safeguarding Policy applies to Fermi’s coordination and sets required conduct standards for tutors. Fermi may restrict or end a tutor’s access to students, stop an unsafe session or arrange a replacement where reasonably necessary. This quality-control role does not make the independent tutor an employee or make Fermi the supplier of that tutor’s lesson.
7. Academic integrity and outcomes
Tutors may explain concepts, review completed work, use comparable practice questions and give feedback where assessment rules allow. They must not produce work for submission, fabricate material, access restricted assessments or misrepresent authorship.
Fermi and tutors do not guarantee Excellence credits, a particular ATAR, UCAT score, interview result or university offer. Outcomes depend on the student and decisions made by schools, examination bodies and universities.
8. Privacy, recordings and materials
Our Privacy Policy explains how Fermi handles information. Tutors are also responsible for personal information they use independently to provide lessons. Recording a lesson or using a student’s image or testimonial requires prior permission. Teaching materials remain owned by Fermi, the tutor or other rights holder and are for the student’s personal learning unless otherwise agreed.
9. Concerns and legal rights
Send concerns and relevant booking details to Woojin. Fermi will address concerns about its agency services and help coordinate concerns about a tutor’s lesson. The tutor remains responsible for the tutoring supplied by that tutor; Fermi remains responsible for services Fermi supplies.
Nothing in these terms excludes or limits rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020 or other mandatory law. New Zealand law applies without excluding mandatory rights that may apply elsewhere.
